Effective Date : You have accepted our T&Cs once you purchase our product.
These Terms and Conditions (“Agreement”) govern the use and purchase of StabApparel’s Ultra-high-molecular-weight polyethylene (UHMWPE) fiber samples (“Product”) for use or testing purposes. By accepting the Product and conducting any testing, you (“Tester”) agree to the following terms:
1. Testing Guidelines
1.1 Test Surface Requirements:
The UHMWPE fiber sample provided by StabApparel must only be tested using appropriate materials that closely mimic the characteristics of the human body. The following materials are approved for use during testing:
- Memory foam padding
- Steak or meat
These materials are required to simulate the elasticity, thickness, and density of human skin and tissue. Testing on surfaces that do not imitate the body may lead to inaccurate results and potential damage to the Product. See Video on website.
1.2 Prohibited Surfaces:
The Tester is strictly prohibited from testing the Product on hard or rigid surfaces, such as tables, floors, plastic, or any surface that does not replicate human body properties. Failure to use memory foam or steak/meat padding to mimic the body when testing will be deemed improper testing.
2. Liability for Improper Testing
2.1 Liability for Damage:
If the Tester conducts testing on a hard surface without using memory foam padding, steak, or meat as required, the Tester will be fully responsible for any damage caused to the Product. This includes, but is not limited to, any tears, punctures, or loss of integrity to the UHMWPE fiber sample.
2.2 Vandalism Clause:
Improper testing on prohibited surfaces that leads to damage will be classified as vandalism under this Agreement. Such actions void any rights to product warranty, exchanges, or refunds.
3. No Refund Policy
3.1 No Refund for Improper Testing:
In the event that the Tester damages the Product by failing to follow the required testing methods (e.g., not using memory foam or steak/meat), StabApparel will not issue any refund or replacement. The Tester acknowledges that by disregarding the testing guidelines, they forfeit any claims for product defects or dissatisfaction.
4. Product Care and Handling
4.1 Proper Use:
The Tester agrees to handle the UHMWPE fiber sample with care and in accordance with the testing instructions provided. Any attempt to test the Product in a manner inconsistent with these instructions will void all warranties and rights for further claims against StabApparel.
5. Indemnification
The Tester agrees to indemnify, defend, and hold harmless StabApparel, its officers, directors, employees, and agents, from and against any claims, damages, liabilities, and expenses (including legal fees) arising from the Tester’s failure to adhere to the guidelines set forth in this Agreement, including any damage caused to the Product during improper testing.
6. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of EU & UK Jurisdiction, without regard to its conflict of laws principles.
7. Severability
If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
8. Entire Agreement
This Agreement constitutes the entire understanding between the Parties with respect to the testing of UHMWPE fiber samples and supersedes all prior agreements, understandings, or representations, whether oral or written.
9. Amendments
StabApparel reserves the right to amend these Terms and Conditions at any time by providing notice on its website. Continued use of the Product after such notice constitutes acceptance of the amended terms.
IN WITNESS WHEREOF, the Tester and Buyer agrees to the terms and conditions set forth above by conducting any testing on the UHMWPE fiber provided by StabApparel.
